This ruling was a summary judgement, which means there was no actual testimony given. This means the judge made a decision in a vacuum, nothing but old-school brick and mortar values to go on. There will be injunctions against my.mp3.com continuing, but there will also be an appeal.

During the appeal process there will be plenty of expert witness testimony to explain why the my.mp3.com service is just the latest innovation in content delivery. Just as the industry fought 8-track, cassette, vhs and compact discs, so are they fighting online, on-demand delivery. Just as they "lost" all those battles and ended up with a greatly expanded business, so to will my.mp3.com eventually "win" and in so doing will also grow the market for content too.

Whether the win is in court or through a licensing agreement, the win will come and mp3.com has a good chance of coming out of this better off then ever before.
