The "law is the law" seldom applies during the tenure of this Administration. But nevertheless, while you may be correct from a legal standpoint, I was not speaking "legally" but about intentions and the motivations of the parties. The post was directed to those who judge the relatives harshly. My point was that if you balance the motivations and intentions of the parties against the relationship of father to son, I think the father clearly comes put ahead in the absence of any credible proof of abuse, neglect, etc. This does not demean the intentions and motivations of the family. I believe they believe they are acting in the boy's best interests and while I do not agree with them I would not judge them harshly as I do have sympathy for their feelings. Although I go with the father in this case, one must wonder what it is about Cuba that makes people willing to risk their lives to escape and would I (being ignorant of all the facts about life in Cuba) want my son to grow up there with me or here with relatives. BTW, I think the question of whether a six year old may ask for asylum is an interesting one. My guess is that Elian is really too young to know what he really wants. But it will be interesting to see the resolution.
