chulu, using this theory, why even have a family court? Why don't we just turn over every kid to the surviving father and be done with it? And if some grandparent, uncle, or relative objects. Send the Justice department hit squad in to bash the door down and shove automatic weapons in people's face until they give em up.
We have set up a dangerous precedent here. The COURTS decide these matters, and proper admittance to ones home is ultimately answerable to the 4th amendment. Disregarding its place in our society, sets up a monarchy where power reins supreme and the rule of law is meaningless.
I believe the reason they did what they did is much more basic. The President simply had a hissy fit when they wouldn't bring the child to the airport. So the President said something to the effect. "Who the blankety blank to those Miami Cubans think they're blankety blanken with"? Then turned to someone and said. "what do the polls say". Oh, they support the child being returned to the father sir. "Ok fine, then the hell with those Miami cubans. Send in the troops with machine guns and get the kid". "And if anyone tries to stop them, shoot em". (after all this might make a good case for more gun control)
Notice the racial overtures of "Miami Cubans" spoken so often by the media and this administration? As if they somehow are from a different sub-class, not worthy of 4th amendment protections. Straight from communist techniques. First, paint your enemy as less than human. Then say over and over how they're breaking the law. (while you actually are about to) Then just keep repeating the distortions and lyes, over and over, until people believe them.
Let me see if I can say this as clearly as I can. The government doesn't have the right to bash into a law abiding citizens home with machine guns and snatch a child without a court order! Unless, they believe the child is in danger. Otherwise, we are no better off than people who live in Marxist Communist Cuba. And ANYONE in power can act unilaterally against our citizens and the constitution when they see fit.
I've said enough on this subject, and will simply finish with a posting of the fourth amendment.
