I think Tribe and Dershowitz are wrong. And the long history of immigration cases does not support their points of view. FWIW I don't believe either of those lawyers has much knowledge about this area of law. Immigration lawyers would be the people with the real expertise in this area- and I've heard all of them say that this case was actually a model compared to other INS cases.
