Whatever your opinion about Juan Miguel, right or wrong, cowardice is not grounds for terminating parental rights, nor is his decision not to come to the US, but instead to demand the return of his son to him.
He had been told in January by Doris Meissner (INS Commissioner) that Elian belonged with him and would be returned by Jan 14. The Cuban government expressed concern that Juan would be detained here if he came in an extended legal battle. Their assertion was that the child should be returned to Cuba. Period.
It sounds as if at some point, they began "watching" Juan.
However, it also sounds as if Juan did not want to come here.
Whatever we may think of him as a father for that, it is still not grounds for losing custody.
