Doris Meissner had no call telling Juan Miguel that Elian would be back with him by 1/14, unless she is incredibly naive, and had no idea that there would be any legal challenges, which I find very hard to believe.

Jan. 5: Doris Meissner, commissioner of the INS, sends a letter to Juan Miguel Gonzalez, Lazaro Gonzalez and attorneys for Elian notifying the family of the government's decision that the boy "belongs with his father" and must be returned to Cuba by Jan. 14. Attorneys for the family seek the attorney general's reconsideration of the decision.

"Lack of love"-- I'm afraid that won't cut it,especially as Juan could come up with lots of reasons - whether we like them or not-- why he didn't come immediately. Our child protection laws set a high standard that has to be met before parental rights can be interfered with or terminated, based on abuse or harmful neglect. As a judge, I think you'd get struck down a lot on appeal with subjective decisions like that ( no offense).
