You're going at this backwards.
Juan proved to the INS that he was the legal father of Elian Gonzales in Dec.
That's all he had to do to establish his rights. He IS the father of Elian---

All parents have rights until they are terminated. You are trying to turn a subjective opinion of Juan and a hatred of communism into some reason to justify taking him from his natural father, and legally, the options are about exhausted. Again, the standards for such an action are set high, necessarily, intentionally, and thankfully so, or we would be inundated with cases questioning half the parents in America.
