There is no Case. Regardless of what special laws may exist for Cubans, the whole matter will rest on "who speaks for the child".

As the answer is obvious, there is therefore no need for a court case, except for the obvious appeals which will undoubtedly ensue due to the fanaticism of the Miami relatives.

The father speaks for Elian and it is his decision as to the choice of country.
