Last time I looked, you were the one insisting on calling Elian's father a "deadbeat Dad" and accusing him of orchestrating the use of "storm troupers" (BTW, the correct spelling is "troopers") in the boy's recovery, without a shred of fact or logic to support either contention. But if you want facts and logic, so be it.

Lazaro's DUI convictions and Marisleysis's medical records are documented facts, facts of the sort that are definitely germane to custody cases. No similar facts have appeared to suggest that the boy's natural father is not fully qualified to raise him. In any event, those documented facts are moot, because the court has already established what everyone with a shred of common sense knew in the first place, that a US court has no jurisdiction over Elian's custody arrangement.

More facts:

Asylum laws set a well-founded fear of persecution as a condition for the granting of asylum.

There has been no suggestion on anybody's part that Elian faces any probability of political persecution

The conduct of the raid may have been criminal or merely dumb, but that is a matter to be worked out between the offending party (the Justice Dept.) and the courts. It has no bearing on what happens to Elian. He is now with his legal custodian, and his asylum petition has no chance of being approved. The logical course of action for everyone to follow is to shut up and let the kid go home with his father.
