I just received a response from Steve Burke to the following question: If you can, please provide more detail on just what aspect of your test kits is Becton Dickinson claiming infringment, and what is your position on this matter? Answer: In regards to the lawsuit against Quidel there have not been any new developments to announce as yet. The technology envolved relates primarily to the antibody / color label complex which provides a visuel result. As we have stated, we believe we do not utilize this technology and do not infringe their patents. Thank you for your continued interest in Quidel. Sincerely, Steve Burke CFO
