I know you don't much care for this sort of thing, but perhaps you will indulge one more round of legal questions... The court ruling you cited seems to leave Elian's father as the sole legal custodian of the boy. If that is the case, would the Miami relatives still have any standing to file or pursue an amnesty petition? If the boy's father is the legal guardian, couldn't he withdraw that petition at any time?
