Sorry Gerald. That may be what you wish the law to be, but it isn't what I learned in law school.

Then, since you learned this in law school, tell me the exact legal definition that allows a company to know beforehand without a doubt the exact time that it becomes a monopoly so that it can immediately stop activities that were previously legal but at that exact instant become illegal. Tell me how a company can know exactly how narrowly its market will be defined in a future antitrust case so that it can calculate beforehand its Magic Marketshare Number for the previous sentence and can take necessary proactive steps to avoid violating the law, without unnecessarily curtailing legal behavior and harming the company's competitiveness.
