And if you are going to speak of Elian's rights independent of his father, tell me this: at what age do YOU believe a child is capable of making rational life decisions for him- or her-self? Is a two year old who can scrawl an X on a piece of paper and call it a signature entitled to make life decisions for herself?

I think my kids are pretty bright, and their grades in college tell me that they have learned to succeed in that environment which people generally associate with brightness, but when they were six I can damn well tell you they did NOT know what was best for them.

I did. I made those decisions for them.

I have never seen a tenant of Libertarianism which says that six year olds should be allowed to decide where they want to life, with whom, what they should eat, when they should go to bed, etc.

Elian is a tool. He has not asked for asylum. He is incapable of making a rational decision about asylum. He is capable of being bribed by consumerism. He is capable of being coached into wagging his finger on TV. But he's not capable of making the decision on his own in his best interests.

And the Cuban exile community in Miami sure as H isn't capable of making a rational decision about ANYTHING affecting Cuba.
