You are ignoring that rights belong to individuals not groups. If you smoke what if it bothers me? Assuming that 2nd hand smoke is harmful, how could this apparent conflict be resolved? The ans., one of the parties moves away. How should the moving party be determined? By property rights If you are in my restaurant and smoke, I say "not on my property you don't." It would then be your choice to leave or stay (and not smoke). There was a conflict in desires- rights settled the matter. There was no conflict in rights, but there was a conflict in desire.
