SCRAPPS-SPLS/ODP has filed with the courts to fight the attempt
to prevent the merger. The case is scheduled to be heard the
end of May. Its my understanding that the SPLS/ODP/OMX superstores
have only 10% of the market share. Since their highly visible and
advertise alot, we dont realize that 90% of the market share still
belongs to the walmarts,k-marts,warehouse clubs and especially the
small independent office supply stores. So its hard to understand
what the real importance of the the govts contention that SPLS/ODP
have less competitive prices in some cities. If thats true,the
consumer has many other places to buy office products that could
provide better pricing.

An interesting scenario is the following: when the govt was reviewing
the merger, it was taking comments from the general public. I
wonder if the govts decision was tainted by the small store owners
making negative comments about the merger because of their fear of
the big getting bigger.
