I have this copy of Windows that I did not want and do not use.

You made a choice to purchase a hardware/software bundle that included it. I will agree that since the license says you should return the software to the dealer for a refund if you don't agree with the terms then you should be able to get a refund of the amount the dealer raised the price of the system to cover its cost, no more, no less, from the dealer. You are not owed the list price of Windows. If the dealer says that it only sells the hardware and OS together as a package, like Sun, then to get your refund you may have to return the entire computer. (Can someone buy a Sun computer and return the Solaris OS that they don't want for a refund?)

I've heard the complaint before that someone can't buy an XYZ computer without Works or without Windows. Well, too bad. That's the way the computer and software is bundled by XYZ. A customer has the right to buy from the retailer that offers what he wants, but he doesn't have the right to dictate what a specific retailer sells. There were a few places where you could buy a bare machine or one with Linux in the past without having to build it yourself, and now there are many. You have only yourself to blame for the choice you made.
