I have asked the question before and can't find anyone who has the answer. Hope this time someone will come forward and help us.

The question is this.

If an insider shorts a stock at broker X while he is long the same stock at broker Y and he covers the trade at broker X, does this constitute a trade under the regulations?

If the stock actually goes up after the short sale at Broker X and is then covered by a delivery of the stock by broker Y then is this a trade? For sure this is a trade and has to be (read should be) reported.

But if the stock goes down and the position is covered at broker X (at a profit to the insider) is that a trade under the definitions of the regulators?
