Ref AOL, by backing the DOJ and bringing a bogus case upon MSFT they have only made it easier for the FTC/DOJ to come back at them one day.

It does not matter what AOL says it is going to do, one only has to look at their actions. Taking DIS off the air. If AOL can do that to a big company what can they do to smaller players? AOL already has a suit pending with a small company, many other are lined up against it with regards to IM. AOL is no longer some young upstart. They are a large in influential company. They are edging and pushing on the turf of others.

Since using the DOJ is a legitimate way for companies to obtain what they can not in the marketplace via competition, in part due to the actions of AOL against MSFT, that is what they have sown.

I see you have tried to put up an argument and talk about contracts and such, but after the MSFT case we all know that just doesn't matter. AOL-TWX is getting too big a footprint in the internet space and someone will cut them down to size over the next five years.
