There are other problems with cross holdings; Japan is exhibit #1.

As far as poolings are concerned, CSCO would be prohibited from share buybacks for 2 years, I think. Given that part of CSCO's strategy depends on continual acquisitions, many of them poolings (including the most recently announced ARPT acquisition), I wouldn't count on a share buyback any time soon from Cisco. As far as I know, there is no penalty that CSCO could pay to permit a buyback. The rule is there for a very good reason, to prevent manipulation in a merger.
