How about if Juan decides he and Elian should stay, then a year later decides he wants to be a Canadian citizen because he thinks America treated him poorly. Would Juan and Elian be forced to stay in America? Who will make sure that they stay in America? What if they just want to go on vacation to Canada, or Mexico or Cuba. What if Juan wanted to take Elian back to Cuba to visit his grandparents. Would we have to stop them? Do the exiles want to force Juan and Elian to live in the exile community in Miami to make sure they don't escape?

Just stop and think about the ridiculous scenarios you can devise. Would the exile leadership hire spies to follow them around to make sure they didn't try to make a run for it? Would phones be tapped? Would there be ("body") guards that followed them around? Would that crazy Miami mayor involve the police? Sounds a lot worse than the Cuba the exile community says is so awful that Elian should be torn from his father.

That should tell you something about the Miami relatives and their lack of logical reasoning ability.
