Bill, we have gone over and over this- but I will mention some of our discussion right here in case it has slipped your mind:

The requirements call for an extended period of time during which the father has had no contact at all with the child (I believe X cited some state requirements of 6 months min. but it's irrelevant because Juan talked regularly on the phone with Elian until the relatives started trying to prevent him from doing so) Juan is also able to claim promises were made by our govt that Elian was being returned to him on several much earlier dates.

But that is not the question.
Indeed it is for YOU to prove that he was legally unfit. THis is where you and joe seem to run into some weird wall of emotional wish fulfillment-- you make these unsupported accusations and then you say- PROVE HE ISN:T!. The law doesn't work that way.

AJoe just stated flatly (and ludicrously) that Juan Gonzales was not a natural father within the meaning of the law.
I asked him to define and support that statement.
My guess is he can't -- any more than he can provide support for his statement that the panel of judges are leaning toward keeping Elian in the US.
