I think it is axiomatic that if the Microsoft applications bypass the published APIs, it is because they were not complete or efficient enough to do the required job. What has been missing is a level playing field for external applications versus Microsoft developed applications. The interface is not only incomplete, but is not released to the public until the Microsoft applications are nearly complete creating a huge time penalty for the external developers. This behavior should be addressed by any settlement.
