Donato Dalrymple is irrelevant. (You brought him up, not I.) He doesn't belong in a discussion of the facts of the case, any more than he belonged in the closet or in the bedroom with Elian. Anyway, if we are handing out halos one should go to the cousin who actually jumped in the water and pulled Elian out.
Dalrymple is an opportunist of the worst sort, who milked every TV appearance, took freebies, extolled his own virtues and made some of the absolutely stupidest and blatantly self-serving remarks I have ever heard. He makes my skin crawl.
Other than that, I have no feelings about him one way or another :)

As for your E. German example-- 'what if's' are slippery and dangerous as they offer no facts to study, and the situations seldom can be equated, so I won't try to answer that question.
