And it's the same royalty, whether they sell products for CDMAone, whether they sell the products for MC CDMA, or whether they sell it for DS CDMA.

Same royalty rate, sure. The problem that exists for them, is that when the same royalty rate is applied to both CDMA2000 and W-CDMA, you get two different numbers. Because the amount of essential IPR that they have in WCDMA is not even comparable to their standing with CDMA2000.

So, then the response would be (of course) "It doesn't matter if only one CDMA patent is infringed, because QCOM will charge on the whole patent portfolio."

To which I would answer, what infringement? IDCC claims they can get around it.

p.s. Did I mention that IDCC claims they will receive royalties on all CDMA2000 handsets (bi-modal or not)? And HDR as well?
