Yes, it is unfortunate that is is 6, and not 8 or 10.

However, I still feel it should be his choice. And he must be fully-informed by the court, whether he has the capacity to understand or not.

It is really not that hard to understand. He must be told that he can stay with his father, who will take him back to Cuba, or he can stay with his relatives, and he will stay here.

Not that difficult to get across.

And then let him choose.

I agree it is a tough thing for a 6 year old. But he is, obviously, a tough boy. He can decide.

The sad thing on both sides is the notion that a child has no rights - is a possession to have his chosing done for him.
