But isn't the 2nd Amendment issue confused by the "well-regulated militia" language? We can't assume the language is meaningless--so what type of limitation or proviso does it place on the rest of the language?

In other words, why not just say the right to keep and bear arms shall not be abridged, or why not just say "a militia", why is it important for the framers to have decided that reference be made to not only a militia, but a militia that is "well-regulated"? Regulated how, and by who?

These questions are not quite as simple as you make them out.
