I think Bear Down has a much better understanding of what happened than you do. Read his first paragraph again. He is pretty astute in his reading about the Judge. If the Judge was going to rule in favor of Tony's motion or even consider it then the prosecution would not have been denied. The Judge had already made up his mind.

Then you should ask yourself how and why the Judge made up his mind. Based on what evidence, what knowledge, and from what sources?

Did A&P get the absolute minimum? No.

I firmly believe there were outside influences on the Judge.
Just because a Judge doesn't hear something in court doesn't mean that he/she hasn't heard it elsewhere through various means. Do you think the Judge didn't know anything about Tony's background????? Good and bad? Even people from RagingBull were writing the prosecutor and the judge to let them know things about Tony.

Compare the case of the convicted embezzler/armed robber to Tony's case. Strip EVERYTHING away and just compare the cases on the facts and look at the sentencing. It should make you think about what else is out there looming, but I am sure it doesn't.

Should outside things influence a Judge on a particular case? That is entirely another matter.
