I agree you don't deal with the dictator that way- but it is my opinion that the people of that country when in YOUR country deserve to be treated justly and fairly, as any human would be- the "sins" of their government not attaching to them personally.

You may not understand my opinion clearly regarding the department of justice and the INS. I completely agree with you that the situation should never have been created- Elian probably should NEVER have been released to Lazaro. I am amazed at how little scrutiny seems to have been given (initially) to the people this child was temporarily turned over too. I hope they learn from this to slow the process down and gather more facts. If they had simply put Elian in some neutral foster care this would never have happened.

But you will not be satisfied if the hearing about whether or not to have an asylum hearing goes against the right of a child to petition independently of his parents? Because the matter is being heard- it is being heard about whether to hear it. Is that too little of a hearing? Would it bother you a great deal if it turns out that children under the age of 11 or 12 cannot petition for asylum against the wishes of a parent (barring a justified fear of a threat of persecution, or fear of harm from his or her own family- because I found reference to that in ALJ cases- but Elian's case does not fit those facts).
