Karen, I must confess it is the second time I have brought this concept of enforced asylum up. Indeed asylum is a grant and not a sentence. That is the whole flaw in the enforced freedom that the students of Aristotle and Ayn Rand would force on others.

Not only is the issue of who speaks for Elian with regard to seeking asylum an issue, but who shall speak for Elian about whether he takes advantage of it if granted. If you cannot take Elian away from his father, then he is free to leave and return to Cuba.

If you do take Elian away from his father, then given that there is no other cause (there has been no representation yet that Juan is abusive to his son) but that he would return him to Cuba, then the precedent is highly disturbing.
