The whole case is moot. Some of the low breeds here on this thread don't seem to understand that the court is simply hearing whether Elian has the right to apply for asylum.

Elian is obviously a minor. Unless some court strips him of his rights, Juan remains his guardian. As his guardian Juan will be the one who determines where Elian will live, regardless of the court's decision. Since the father, Juan, has already stated his intention to return to Cuba it is why I say the case is moot.

Furthermore, for the deadbeat relatives in Miami to gain custody of the child in the hope of becoming the "guardian", they would have to prove that Juan is an incompetent father. IMO, I would think a judge and/or jury would be very hardpressed to remove Elian from what appears to be a loving family.
