Carl: How shrewd was Rupert? Or how niave? Echostar has a pretty good track record with their lawsuits, and I don't think that they would have instituted this one (given its implications) unless they felt they had a good case. Interestingly, if they win (and given the urgency of the issue, I'm sure they'll get an expedited ruling), I think it would be hard for Rupert not to complete the merger. After all, who gives a sweetheart loan of $200m to their competitor?
