Geography and physical custody of the child answers your question. When both parents and the child were in Cuba, the parent who wanted to be in the US had to just take the child in order to accomplish that goal. If both mother and child had survived the trip, Juan Miguel would have been out of luck. He could have come here to demand his son's return but no way would a court have returned Elian to him if his mother were alive. Since the mother is dead her wishes are legally moot.
