I don't know what country you're posting from, but here in the US we have an "independent judiciary". Federal judges receive lifetime appointments. If there is an opening, a president nominates a replacement. If someone is in the job when power changes, that person stays in the job.

Also, the states are plaintiffs too. The DoJ can drop out of the suit, but it cannot prevent the states from continuing their suits.
