Russ: Yes, I was/am aware of the independent judiciary. I was only 'typing out loud', without enough detail, that G.W. Bush if elected (as with any other president) is allowed to replace a vacancy that is reflective of their conservative or liberal point of view.

Also, the states are plaintiffs too. The DoJ can drop out of the suit, but it cannot prevent the states from continuing their suits.

If the DoJ were to drop out, I would be willing to bet a dollar to a doughnut the states would follow. The pack tends to stick together.
