"No, but you have to realize he's a lawyer and therefore suspicious and creative by nature. They have to make a case where none exists. I wish he posted here so he could get a fair trial for his assertions."

Thought is was about time to join SI. With respect to the increased sub projections, I didn't mean to imply that divestiture of RR was being counted on for near term projections. Of course I could be mistaken but I was really thinking that ATHM was counting on subs from the MediaOne properties for their projections a couple of years out, not based upon what the DOJ would do, but based upon the 3/28/00 commitment made by T to use ATHM for platform and connectivity services on all customers of its high speed access services provided on the MediaOne properties. I had hoped the divestiture would accelerate this, as MediaOne still is under exclusives with RR which I think run until 2002. In addition, while it has not been clear the DOJ would require divestiture, as the ATT general counsel stated yesterday, they knew its was pretty likely.

I wonder how this divestiture will work. Since RR is not public I could find none of its underlying agreements filed. I wonder: (i)if TWX has a right of first refusal on MediaOne's stock, (ii) the RR exclusives in place currently prevent AOL to have access to TWX cable, (iii)whether MediaOne has any veto rights that could prevent the amendment of the exclusivity provisions to allow AOL onto TWX cable, or (iv) whether MediaOne can get out of the exclusivity provisions upon divestiture. Has the making of an interesting deal.
