I agree wholeheartedly, it's amazing to imagine there could be anything on the books allowing some shareholders of a company to participate in the new company, and others not, simply based on size of ownership of like shares. No judge in his right mind should even imagine such action being legal, regardless the circumstances, let alone approve it.
