I'm not an attorney and don't know the ins and outs of all this, but my operating assumption is that anything sent via public telephone lines, whether that be voice, e-mail or fax, is potentially public information and should be considered as such prior to being sent. If one doesn't want one's transmission being plastered on the front page of the Washington Post, for example, then it's best to not transmit it in the first place.

In addition, I'm not sure that a fax, regardless of its clarity, has any less povenance than does voice or e-mail.
