I think everyone in the industry knows who has the bulk of essential patents for WCDMA, they just don't want to talk about it.

You might get a feel for the patent issues by wondering over to ETSI's UMTS IPR declaration page:

Qualcomm's declaration is entertaining, to say the least, but then Nokia's isn't overwhelming.
