Dan - in a case where the basic issues of fact and law are so contentious, it seems unlikely that the solicitor general would recommend going right to the supreme court. While there may be constitutional questions in this case, at the moment they are overshadowed by the rather dubious nature of the lower court proceedings, which would require appellate review. Even if the solicitor general recommends that course of action, I think it is highly unlikely that the Supreme Court would accept the case - they will want the additional clarification of appellate review first.
