Dan - frankly, I think that this case is driven by political considerations. The legal system is just the field they are playing on. Depending on which way the wind is blowing, the Solicitor General will make the call that most advantages his boss, which IMO will have nothing to do with right or wrong, justice, or the merits of the case.

But then, as you know, I am a little jaded when it comes to the legal system.
