Maybe Jackson will NOT rule to break up MSFT---maybe his question to DOJ last week re "wouldn't there simply be 2 gorillas (paraphrasing) instead of 1" was his way of thinking out loud that he actually was leaning on NOT breaking the Company up---it's just that everyone may have misinterpreted his intent--he may have already decided that he was likely going to leave the company whole and that he simply wanted the DOJ to file a rehashed brief (to consider the 3 part alternative rather than 2) so he could satisfy himself that leaving MSFT whole was the right thing to do----My intuition is that there is a material chance that Jackson may surprise people and rule soon that MSFT will be kept whole----and THAT would cause the stock to rally since Rick Sherland's view re the parts being worth less than the whole is why the stock weakened in the last few days (ps I agree with Sherland)---maybe the reason why Jackson dismissed MSFT's ideas of more time to review breakup idea was that JAckson has no intention of going that route and only JAckson at this point knows that.
