New Trial In Rape Case

HARTFORD, Conn. (AP) A man convicted of rape in New Haven in 1995 may get a new trial because jurors weren't told that the detective investigating the case allegedly had sex with the victim.

The state Appellate Court this week ordered a new trial for Robert Horrocks, who was sentenced to eight years in prison for the alleged 1995 attack.

The Appellate Court ruling says Horrocks deserves a second trial on grounds that he was denied a fair trial the first time.

According to court papers, the alleged rape victim told a neighbor she had ''wild sex'' with the detective investigating the rape the same night of the attack.

The three-judge appeals court ruled unanimously that the judge in the first trial should have allowed that evidence into testimony.

The detective, Vincent Raucci Jr., has had his own run-ins with the law. Raucci retired in 1996 and for two years lived as a fugitive in New Mexico after he jumped bail on domestic violence and larceny charges.

The appeals court ruled that the evidence of the detective's relationship with the victim was necessary to help establish Horrocks' claim that his sexual encounter with the woman was consensual.
