Yaacov - The judge does not have the power to send the case to the supreme court - in fact, he can't send it anywhere. The DOJ can't either. If MSFT appeals, a completely new entity, the solicitor general, can make a recommendation - but even that is not sufficient. The Supreme Court must decide to hear the case, and in the past, they have rejected cases where the constitutional questions have not been clearly defined by the lower courts, or where issues of law unrelated to the constitutional questions have yet to be resolved.

Jackson seemed a little biased to me, but no one was without sin, and the MSFT defense was terrible IMO.
