I just got off the phone with an attorney friend of mine who also has invested in cybr, and he spoke to cybr's lead attorney today. A few facts:

1.Cybr will not be bankrupted defending the class actions because they have a D&O policy(Director and Officers) which they have specifically taken for just such occassions. This policy is for defense only and doesn't go toward for pursing another law firm to go after illegal shorting.

2.Cybr has hired the law firm of Rosemen & Colin who specializes in defending companies who have CA pending. They are security specialists. According to him they are a top rate firm with a good reputation.

3.In the lawyers opinion once FDA is approved much of the reason for the suit should fall by the wayside.

4.Cybr has hired a new PR firm, wouldn't say which one.

5.Cybr has responded to any and all SEC inquiries.

6.No problems with FDA, and all is on track for approval sometime very soon. Repeat no problems with the FDA.

7.Cybr management continues to have meetings with major companies, and nothing that has gone on has effected the business plan.
