Microsoft had their day in court. They lost. Deal with it. After they lost, the case entered the penalty phase. You do not get a new trial for the penalty phase. The judge takes recommendations form attorneys for both sides, but is not bound by them.

Microsoft claiming that they are entitled to a trial for the penalty phase, and that that trial should be longer than the original, is one of the weirder things I have heard. I want to know what they're smoking.
