We have sought to have our day in court" Microsoft had their day in court. They lost. Deal with it. After they lost, the case entered the penalty phase. You do not get a new trial for the penalty phase. The judge takes recommendations form attorneys for both sides, but is not bound by them. Microsoft claiming that they are entitled to a trial for the penalty phase, and that that trial should be longer than the original, is one of the weirder things I have heard. I want to know what they're smoking. -Russ
