Govt is scrambling, govt should settle to save face.

Microsoft spokesman Jim Cullinan said ``This new delay should raise some serious questions about the government's plan and the entire process employed in this case,''

Cullinan said David Boies, the government's lead trial attorney, acknowledged during the conference call that Microsoft had raised a number of valid points about the proposed decree.

There was no immediate comment from the Justice Department, which yesterday characterized Microsoft's filing as ``another effort to posture for appeal.''
