JM is under no obligation to stay in the US any longer.

The injunction is still in place. The Miami relatives have already given notice of appeal. Also, "..the judges denied a motion by Eli n's father to replace the boy's great-uncle L zaro in the asylum case. Had the judge granted the motion, Juan Miguel Gonz lez would have been able to drop the asylum request and take him home to Cuba."

Minutes after the ruling, lawyers for the boy's Miami relatives sought help from Supreme Court Justice Anthony M. Kennedy, who handles emergency matters from that judicial circuit for the nation's highest court.

The request urged Kennedy's help ''to assure that Elian will remain in the United States'' until the full Supreme Court can consider a formal appeal of today's appeals court ruling.

"No child, whatever may be his immigration status, deserves fewer judicial rights than hardened criminals. Surely, this traumatized and innocent child deserves the court's consideration and protection,'' the request said.

Kennedy has the authority to act on the request himself, but he is more likely to refer it to the full Supreme Court.

Looks like J-M and Elian are here for a while longer. The relatives are going to drag this out as long as they can and I don't know what legal options J-M has except to try to move things along as fast as possible. One lawyer interviewed on TV said the relatives' best chance at getting the Supreme Court to hear the case is to find a similar case with a different ruling. If they can't it's not likely the SC would be willing to even consider hearing an appeal, she said.
