Jim:

A letter from Hitachi counsel (see May 25 letter) requesting a copy of the license agreement was turned down by the commission.

Letter from Hitachi

Also, in Order #9, Judge Morriss also denied a motion for Summary Disposition / Determination, filed by Sega.

Order Number 9

So I guess RMBS is up 3- 0 so far (ggg).

If accepted, a Summary Determination would have resulted in immediate disposition of the case. I think this is a victory for RMBS, but the consequences are not clear. Of note, Morriss indicates that the current crux of the case with respect to Sega lies in Claim 23, US Patent 6,038,195. All other claims are dependant. Can you give some technical guidance on this one? Thanks in advance,

BP
