If accepted, a Summary Determination would have resulted in immediate disposition of the case. I think this is a victory for RMBS, but the consequences are not clear.

Don't read anything into the Summary Judgement ruling. My experience with legal issues leads me to believe that Summary Judgements were invented to pad the lawyers pockets. Judges simply do not like to grant them because by doing so, it increases the likelihood of an appeal being granted and they don't like having their rulings overturned. So, they merely rule on the side of caution.

Additionally, my attorneys tell me that quite often, judges will deny a motion for Summary Judgement but then turn right around and grant a Directed Verdict on the very same grounds once a trial is underway. In this instance, the grounds for an appeal are weakened as the other side has had the opportunity to present their case.
