I think that the Bottom line is that QCOM seems to be in the drivers seat and it will not agree to it unless it sees it in its best interest.

Agree 100% that QCOM not playing "patent pool" is the correct strategy and bi-lateral negotiations are best.

To stretch your analogy, Q may be in the driver's seat of the biggest baddest SUV on the road, but there's still a lot of traffic on the WCDMA highway to contend with - and apparently some of the other drivers will attempt to violate all manner of rules of the road (like running the tollbooths) in order to cut off that big, bad SUV, as well as trying their darndest to block the entrance ramps and keep traffic off the uncrowded MC tollway.

So, the engines have been started, and the race is on.
